RESIDENTIAL RENTAL AGREEMENT

This Residential Rental Agreement ("Agreement") is entered into at [CITY] on [●] between:

1. [LANDLORD FULL NAME], S/o [FATHER'S NAME], residing at [ADDRESS], Aadhaar No. [●] / PAN [●] ("Landlord"); and

2. [TENANT FULL NAME], S/o [FATHER'S NAME], residing at [CURRENT ADDRESS], Aadhaar No. [●] / PAN [●] ("Tenant").

1. PROPERTY
The Landlord hereby lets out and the Tenant hereby takes on rent the residential premises situated at:
[FULL PROPERTY ADDRESS INCLUDING FLAT/DOOR NUMBER, BUILDING NAME, STREET, CITY, PIN CODE]
("Premises")
comprising of [●] BHK, measuring approximately [●] sq. ft., along with [parking space / storage / other amenities — delete/add as applicable].

2. TERM
2.1 This Agreement shall be for a period of [11] months commencing from [START DATE] and ending on [END DATE] ("Term").
2.2 This Agreement shall NOT automatically renew. Any extension must be executed by a fresh agreement or written addendum signed by both Parties.

3. RENT
3.1 The monthly rent payable by the Tenant shall be INR [●]/- (Rupees [●] only) ("Rent").
3.2 Rent shall be paid on or before the [5th] day of each calendar month.

3.4 Rent Escalation: Upon renewal, the Rent shall increase by [●]% per annum.

4. SECURITY DEPOSIT
4.1 The Tenant shall pay a refundable security deposit of INR [●]/- (equivalent to [●] months' rent) ("Security Deposit") upon signing this Agreement.
4.2 The Security Deposit shall be refunded within [30] days of vacation of the Premises, after deduction of any amounts due for: (a) unpaid rent; (b) damage to the Premises beyond normal wear and tear; (c) unpaid utility bills.
4.3 The Security Deposit shall NOT bear any interest.

5. UTILITIES AND MAINTENANCE
5.1 The Tenant shall bear all charges for electricity, water, piped gas, internet, and cable TV.
5.2 Society maintenance charges of INR [●]/month shall be borne by the [Landlord / Tenant].
5.3 Minor repairs costing up to INR [2,000] shall be the Tenant's responsibility. Major structural repairs shall be the Landlord's responsibility.
5.4 The Tenant shall maintain the Premises in good and tenantable condition.

6. USE OF PREMISES
6.1 The Premises shall be used solely for residential purposes.
6.2 The Tenant shall not:
(a) sublet, assign, or part with possession of the Premises;
(b) carry on any commercial, illegal, or immoral activity on the Premises;
(c) make any structural alterations without the Landlord's prior written consent;
(d) keep pets without the Landlord's prior written consent.

7. LOCK-IN PERIOD
The first [●] months shall be a lock-in period during which neither Party may terminate this Agreement except for material breach. If the Tenant vacates during the lock-in period, the Security Deposit shall be forfeited.

8. TERMINATION
8.1 After the lock-in period, either Party may terminate this Agreement by giving [1] month's prior written notice.
8.2 The Landlord may terminate immediately if the Tenant fails to pay Rent for [2] consecutive months or commits a material breach of this Agreement.

9. INSPECTION AND ACCESS
The Landlord or authorised representative may inspect the Premises with [24] hours' prior notice to the Tenant.

10. HANDOVER
Upon expiry or earlier termination, the Tenant shall:
(a) vacate and handover the Premises in the same condition as received (reasonable wear and tear excepted);
(b) return all keys;
(c) clear all utility dues.

11. GOVERNING LAW
This Agreement is governed by the Transfer of Property Act, 1882, and applicable State Rent Control legislation. Disputes shall be subject to the jurisdiction of courts at [CITY].

12. REGISTRATION
This Agreement [shall / shall not] be registered. If registered, registration charges shall be borne equally by both Parties. [Note: Agreements exceeding 11 months must be registered under the Registration Act, 1908.]
